The order is a binding offer. The photographer can choose to accept this offer within 4 weeks by sending an order confirmation or by sending the ordered photos to the customer within this period. A contract between the photographer and the customer is concluded when the customer sends an order and this is confirmed in writing by the photographer (also by email). The confirmation is made subject to the availability of the photos ordered.

The digitization, storage and duplication of the photographs of the photographer on data carriers of all kinds requires the prior written consent of the photographer. The transfer of usage rights does not include the right to save and reproduce if this right has not been expressly transferred. The dissemination of photographs of the photographer on the Internet and in intranets, in online databases, in electronic archives, which are not only intended for the customer's Internet use, on floppy disks, CD-ROM or similar data carriers is only permitted on the basis of a special agreement between the Photographers and the customer permitted.

The transfer of digitized photographs on the internet and intranets and on data carriers and devices that are suitable for public reproduction on screens or for the production of soft and hard copies requires the photographer's prior written consent.

The duplication and distribution of adaptations that the photographer has made electronically require the prior written consent of the photographer.

The photographer is not obliged to hand over data carriers, files and data to the customer unless this has been expressly agreed in writing.

If the customer wants the photographer to provide him with data carriers, files and data, this must be agreed and paid for separately. If the photographer has made data carriers, files and data available to the customer, these may only be changed with the prior consent of the photographer.

The customer is responsible for the risks and costs of transporting data carriers, files and data online and offline; The customer can determine the method of transmission.

The photographer is entitled to the copyright on the photographs in accordance with the copyright law.

The use (through advertising, advertising, publication, etc.) of the photographs I produce is subject to a fee. All rights of distribution, including through film, television, photomechanical reproduction, storage and recovery in data processing systems of all kinds, reproduction, digital processing and input (via CD, Internet, e-mail, other data carriers, etc.) are reserved to the photographer.

The photographs produced by the photographer are generally only intended for the client's own use. If the photographer transfers rights of use to his works, only the simple right of use is transferred, unless expressly agreed otherwise.

A transfer of usage rights requires the special agreement. The rights of use are only transferred to the photographer after the fee has been paid in full.

The person ordering a photograph i. S. from § 60 UrhG has no right to reproduce and distribute the photo if the corresponding rights of use have not been transferred. § 60 UrhG is expressly excluded. When utilizing the photographs, the photographer can request to be named as the author of the photograph, unless otherwise agreed. A violation of the right to be named entitles the photographer to compensation.
